Terms and Conditions

Age of consent :

 

By purchasing products from KOUBI DESIGN at koubidesign.com, you declare that you are 18 years of age or above or have the legal right to possess KOUBI DESIGN products & tools in your area or community. If it is discovered that you are not of the legal age to purchase from the website, KOUBI DESIGN is not obliged to accept your order.

 

 

2. Contract formation and orders :

 

2.1 You are deemed to place an order with us by ordering via our online checkout process. As part of our checkout process you will be given the opportunity to check your order and to correct any errors. We will send you an order acknowledgement, detailing the products you have ordered, within 24 hours.
2.2 Our acceptance of an order takes place when we despatch the order. When we despatch the order the purchase contract will be made , unless we have notified you that we do not accept your order or you have cancelled your order.
2.3 We may refuse to accept an order :
(a) where goods, services or information ordered by you are not available ;
(b) where we cannot obtain authorisation for your payment ;
(c) if there has been a pricing or product description error ; or
(d) if you do not meet any eligibility criteria set out in our terms and conditions.
(e) if we do not deliver to your area;

Where we do not accept your order but have processed your payment, we will re-credit your account with any amount deducted by us from your debit or credit card as soon as possible, but in any event within 30 days of your order. We will not be obliged to pay any additional amount as compensation for disappointment.

Orders made through www.koubidesign.com are subject to acceptance and availability. KOUBI DESIGN may choose at any time to cancel your order.

No contract will officially exist between yourself and KOUBI DESIGN until your parcel has been dispatched.

KOUBI DESIGN provide a secure checkout provided by PAYPAL for the encrypted delivery of sensitive customer information such as contact and credit card details. 

 

3. Pricing :

3.1 All prices are VAT excluded, but we shall show VAT separately and include it in the total price.

3.2 Where we charge separately for packing, carriage and insurance and other relevant charges, the appropriate rates are set out in our specified pricing structure shown elsewhere on this Website.

 

4. Delivery :

 

4.1 All items ordered are normally dispatched via a 48 hour,but in any event within 7 workdays of your order (except some goods ordered from France), throughout the UK and Republic of Ireland dispatched the next working day after the order is received. If any items are not available for dispatch within the specified timeframe, we will notify you by email and/or telephone.  Weekends and holidays are not included in this calculation.

Shipping costs are calculated based on the total weight of products ordered, and are subject to VAT.

Delivery to non-mainland islands will incur additional charges, please contact us directly on 01179256519 for more information.

 

4.2 You will need to sign for your parcel so that we know you have received it. If you are out when they call, you will be left with a card with details of how to collect your parcel or rearrange delivery at a time convenient to you. Your parcel will be kept for 14 days and if not collected or delivered it will be sent back to us.

 

5. Liability :

 

5.1 If the goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing at our contact address( or by email at  info@koubidesign.com, or by calling of the problem within 10 working days of the delivery of the goods in question.
5.2 If you do not receive goods ordered by you within 7 workdays of the date on which you ordered them, we shall have no liability to you unless you notify us in writing at our contact address of the problem within 10 days of our maximum delivery period of 5 from the date on which you ordered the goods.
5.3 If you notify a problem to us under this condition, our only obligation will be, at your option:
(a) to make good any shortage or non-delivery;
(b) to replace or repair any goods that are damaged or defective; or
(c) to refund to you the amount paid by you for the goods in question in whatever way we choose.
5.4 Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under clause 5.3 (c) above.
5.5 You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.
5.6 Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

5.7 in order to deal with damaged orders quickly we need the following information returned within 48hrs of damaged items being received:

• Name

• Address

• Postcode

• Telephone

• Email address

• Date of purchase

• Products damaged

• Description of damages

Please attach the original delivery label to this document.

Please email images to  info@koubidesign.com of all damaged items or supply a photograph.

 

6. Returns :

 

6.1 If you wish to cancel your order:

(a) you can notify us by email to info@koubidesign.com before we have dispatched the goods to you ; or
(b) where goods have already been dispatched to you, by returning goods to us in accordance with clause 4.2 above.
6.2 You can return goods or cancel an order you have ordered from us for any reason at any time within 14 days of receipt for a refund or exchange.

10 % of the transaction will not be refunded as a restocking charge.
The costs of returning goods to us shall be borne by you.

6.3 Upon receipt of the goods we will give you a full refund of the amount paid or an exchange credit as required, less (if for any reason the these costs have not been paid by you) the costs of delivery to us.
6.4 The rights to return the goods to us as referred to in clause 6.3 will not apply in the following circumstances: -
* in the event that the product has been used
* to any products that we have made or customised specifically for you (eg. but not limited to added colourant)
The provisions of this clause 6.5 do not affect your statutory rights.

6.5 If you would like to cancel a service you are required to let us know at least 1 week prior to the agreed start of the service (eg. but not limited to courses). If you do so, you are entitled to a 100 % refund. You can notify us by calling our office or sending an email toi nfo@koubidesign.com which we can confirm within 3 workdays.  In case you cancel the booking less than 1 week before the start of the service you are not entitled to a refund.

6.6 In case we have to cancel a service (eg. but not limited to courses) we will notify you via email or phone at least 5 workdays prior to the start of a service. Should we find you a suitable alternative date within the next 31 days you are not entitled to a refund.

 

7.Disclaimer :

7.1 Goods or packaging of goods may differ slightly to those displayed on the website.

KOUBI DESIGN  cannot be held responsible for errors or interruption on the website.

 

8.Financial information

 

8.1 All our payments are securely processed by PayPal. We do not download, store or have access to any of our customers’ credit/debit card details or other financial information that is entered into the website during the order process.

Although these details are collected on our site for the purposes of paying for goods ordered, they are immediately passed on to PayPal. Walleffects, its employees, agents and third-party contractors do not store your financial information.

 

9. Copyright :

9.1 Material on this site may not be copied, reproduced, republished, downloaded, posted, broadcast or transmitted in any way without the permission of KOUBI DESIGN.

 

10. Acceptance of terms and conditions :

 

10.1 Use of this site constitutes your acceptance of these terms and conditions, which take effect on the date of which you first use the site. These Terms and Conditions do not affect your statutory rights.
